Only one week after the approval in Catral of the Law to authorize to give Certificate of Habitations in Catral, Albatera Town Hall has definitely approved a law to give CH also in Albatera.
This law is now a very positive action from the part of the Town Hall, due to the fact they are now back with the line left in 2011. The Certificate of Habitation was not a problem in Albatera up to 2011. On that time, the Town Hall, stopped to give CH to rustic land properties in less than 10.000 m2, even if the constructions were old and/or even with more than 20 years. This position entered in contradiction with the Spanish High Tribunals decisions, which considered “normal” giving CH to old properties in rustic, regardless the size of the land.
Now, the position of the Town Hall backs to the initial interpretation of the laws.
Each case must be studied individually, but, in general, there are 3 main conditions to consider to apply and get the CH:
– There are not any current fines for constructions, extensions, etc on the property.
– All the constructions inside the property are duly registered in land registry and SUMA (Catastro).
– Installation of a septic tank with depuration system
