DIFFERENCES BETWEEN “CERTIFICADO DE ANTIGÜEDAD” AND “CERTIFICATE OF HABITATION”

QUESTION:  Certicado de Antiguedad; how is it different from Habitation license?

  • A “certificado de antigüedad” is a certificate issued by an independent and private architect which confirms the age of a construction, in a process to legalize or to register that construction.
  • “Certificate of Habitation” also called LICENCIA DE PRIMERA or SEGUNDA OCUPACION. This is an official document issued by the Town Hall from the area, where it is confirmed that the property fulfils with the habitation requirements,  and it that has been constructed respecting and fulfilling the Spanish constructions Laws.

The CH is required from the electric and water companies to change/or to contract the supplying service into your name. The way to obtain this varies depending on the area. But, usually, you need to send an architect to the property in order to prepare the certificate, and then, present it to the Town Hall, and pay administrative taxes.
